Terms & Conditions

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Steve Hillman Photography in writing.

Booking fee: A non-refundable deposit of £100 is required at the time of the booking. Dates are reserved only when the booking fee is paid. This sum will apply towards the contracted fee.

Cancellations: The client may cancel their wedding booking at any time by giving written notice to the photographer. However, they will then forfeit any monies paid.
AND PLEASE NOTE: cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing, to Steve Hillman.

Payments: The outstanding balance for services contracted, must be paid no later than 2 weeks prior to the wedding.

Payments for any additional photography must be paid for when ordering.

All cancellations and re-scheduled wedding dates must be accepted in writing by Steve Hillman Photography

For weddings outside of Cumbria, there will be an additional mileage fee added to the cost. This needs to be negotiated with Steve Hillman at the time of booking and paid in accordance with the payment points above.

Social Media

Steve Hillman will send clients an advanced view of two photographs taken on the day. These will also be available for the promotion of Steve Hillman Weddings. Once the clients have received their complete photographic passage, Steve Hillman reserves the right to use some of the images in Social Media and Advertising promotions.

Weather: Weather permitting, the photographs will be taken as agreed. In the event of inclement of weather, Steve Hillman Photography, in co-operation with the clients will make the necessary changes to the schedule and will do their best to produce full coverage of the wedding within the time option selected.

Coverage: Steve Hillman Photography cannot be held responsible for the lack of coverage caused by the bride, bridegroom or any other member of the wedding party not being ready on time, nor by restrictions placed on Steve Hillman Photography by officials of the church, register office or any venue holders on the day. Steve Hillman Photography does not guarantee the number of pictures to be taken by the photographer on the day, although every effort will be made to interpret the client’s wishes.

Colour Matching: The dyes used for clothing, particularly manmade fibres do not always photograph in the manner in which they appear to the eye. When photographs are printed to produce a pleasing flesh colour such materials may appear incorrect. Steve Hillman Photography will endeavour to achieve the closest possible colour match within the limitations of the materials and processes used.

Licence: Steve Hillman Photography shall be granted an artistic licence in relation to poses photographed and the location used.

The judgement of Steve Hillman Photography shall be deemed as correct in relation to pose and location used.

Display: The client agrees to allow Steve Hillman Photography to display any photographs included in this contract in their portfolio, display areas, internet site, exhibitions, competitions, television broadcasts, magazine or brochure publications.

Copyright: Copyright of all photographs covered by this contract remains the property of Steve Hillman Photography in accordance with the Copyright, Design and Patents Act 1988. The client shall have no right to reproduce, nor to authorise the reproduction of, by any means whatsoever, any photographs created by Steve Hillman Photography. This includes, any hard copies, film, hard disk, tape or any other recording medium. The client hereby acknowledges that infringement of Steve Hillman Photography copyright is unlawful and may lead to prosecution. Steve Hillman Photography reserves the right to grant the client copyright should they require.

General Data Protection Regulations: All personal details are kept in accordance with our GDPR Policy, details are available upon request

Steve Hillman is to be the sole photographer on the day of the wedding unless a different agreement has been reached with the client. Steve Hillman can accept no liability for other photographers or their photographs on the day of the wedding.

Delivery: For services contracted, your photographs will be ready approximately up to three weeks after the wedding date, although this is not a guarantee every effort will be made by Steve Hillman Photography to make the delivery times.

Force Majeure: In the unlikely event that Steve Hillman Photography is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of Steve Hillman Photography, then he will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the contracted event.

Client responsibility: It is the responsibility of the client to inform Steve Hillman Photography in writing of anyone attending their wedding day who does not agree with these terms and condition’s so Steve Hillman Photography can exclude them from the photographs. The terms and conditions listed here cover our wedding service only.

Limitation of Liability: In the unlikely event of total photographic or video failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract.

Images will be supplied via digital means on a password protected Gallery. It should be noted that you are strongly advised to immediately copy/backup your wedding photographs from your Gallery to a suitable computer/storage device. Digital media has a limited lifespan therefor any storage device cannot be guaranteed indefinitely. Also, please note that Steve Hillman Photography are under no obligation to keep copies of your images once released.

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Steve Hillman Photography’s control, including but not limited to camera, hard drive, or equipment malfunction, Steve Hillman Photography liability is limited to the return of all payments received for the contracted event. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Steve Hillman Photography is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year. Neither party shall be liable for indirect or consequential loss.

Any complaints should be raised by the client with Steve Hillman Photography, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
